General conditions of sale
The offer and sale of products on our website ("trameatelier.com") are governed by these General Conditions of Sale. The products purchased on trameatelier.com are sold directly by Paola Palopoli-Ditta Individuale ("the Seller") with registered office in Italy, via Panisperna 55 – 00184 Rome, registered in the Rome Companies Register (T571119504) with REA RM-1725346 and VAT no. 10713681004. You can request information by contacting us via email contatto@trameatelier.com , in case the Customer Service section, present in the "footer" of each page of the Site is not sufficient. Also in the "footer" of each page of the Site, there is the Legal Information section where you can consult: General Conditions of Use , Privacy Policy and Right of Withdrawal .
1. Our trade policy
1.1
The Seller offers products for sale on trameatelier.com and carries out its e-commerce activity exclusively towards its users who are "end consumers".
1.2
When we talk about "end consumer" we mean any natural person who acts on trameatelier.com for purposes not related to their commercial, entrepreneurial or professional activity, possibly carried out and who is of age (>18 years) and therefore in possession of the legal capacity to enter into binding contracts. If you are not a "end consumer", we invite you to refrain from concluding commercial transactions on trameatelier.com.
1.3
In consideration of its commercial policy, the Seller reserves the right not to process orders from persons other than the "final consumer" or in any case orders that do not comply with its commercial policy.

These “General Conditions of Sale” exclusively regulate the offer, forwarding and acceptance of purchase orders for products on trameatelier.com between users of trameatelier.com and the Seller. With regard to the specific sale of e-Gift Cards, the Terms and Conditions relating to the sale of e-Gift Cards prevail over the “General Conditions of Sale”.
1.5
The “General Conditions of Sale” do not regulate the supply of services or the sale of products by parties other than the Seller that are present on trameatelier.com via links, banners or other hypertext links. We recommend that you check their conditions of sale before placing orders and purchasing products and services from parties other than the Seller, because the Seller is not responsible for the supply of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of trameatelier.com and third parties.
2. How to conclude the contract with the Seller
2.1
To conclude the purchase contract for one or more products on trameatelier.com, you must fill out the order form in electronic format and send it to the Seller, electronically, following the relevant instructions.
2.2
Before proceeding with the purchase of products, by transmitting the order form, we remind you to carefully read the General Conditions of Sale and the information on the Right of Withdrawal , to print a copy using the print command and to save or reproduce a copy for your personal use. In compliance with article 51, paragraph 7, of Legislative Decree 6 September 2005, n. 206 (the “Consumer Code”), before proceeding with the purchase of the products, by transmitting the order form, we will provide you with a summary of the commercial and contractual conditions that we propose for the purchase of the products and a summary of the information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the delivery methods of the products purchased and a summary of the information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the delivery methods of the products purchased, shipping and delivery costs; as well as the references, geographical address and contact methods of the Seller and the date by which the Seller undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal. If applicable to the purchase, you will be informed that, in the event of withdrawal, you will have to bear the cost of returning the products, both shipping and duties or customs taxes. In any case, you will be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales service and we will remind you of the possibility of using the platform for the alternative extra-judicial resolution of disputes, accessible on the site http://ec.europa.eu/odr , made available by the European Commission.
2.3
In the order form, displayed immediately before the conclusion of the purchase contract, we will provide you with summary information about the essential characteristics of each product ordered, the price (including all applicable taxes or duties) and shipping costs (including any additional costs incurred by you for having chosen a type of shipping and delivery different and/or faster than the standard one). The contract is concluded when the Seller receives, electronically, your order form, after verifying the correctness of the data relating to your order.
2.4
The order form will be stored in our database for the period of time necessary to process the orders and in any case within the terms of the law. You can access your order form by consulting the My Order section.
2.5
When proceeding with the transmission of the order form, you will be warned that such forwarding implies the obligation to pay the indicated price. Before proceeding with the transmission of the order form, you will also be asked to identify and correct any errors in data entry.
2.6
The language available for concluding the contract with the Seller is Italian or English.
2.7
Once the contract is concluded, the Seller will take charge of your purchase order.
2.8
The Seller may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by email that the contract has not been concluded and that the Seller has not followed up on your purchase order, specifying the reasons. If the products presented on trameatelier.com are no longer available or on sale at the time of your last access to the site or when you send the order form, the Seller will inform you promptly and in any case within thirty (30) days from the day following the day on which you sent your order to the Seller, of the possible unavailability of the products ordered. In the event of forwarding the order form and payment of the price, the Seller will refund, without undue delay, the amount already paid by you and the contract will be considered terminated between the parties. The Seller also reserves the right not to process purchase orders in the cases referred to in the previous paragraph 1.3.
2.9
By electronically transmitting the order form, you unconditionally accept and undertake to observe, in your dealings with the Seller, these “General Conditions of Sale”. If you do not agree with some of the terms set out in the “General Conditions of Sale”, we invite you not to submit the order form for the purchase of products on trameatelier.com.
2.10
By submitting the order form, you confirm that you know and accept the “General Conditions of Sale” and the additional information contained in trameatelier.com, also referred to via links, including the General Conditions of Use and the Privacy Policy and the information on the Right of Withdrawal .
2.11
Once the contract has been concluded, the Seller will send you, by email, a receipt of the purchase order, containing a link to these "General Conditions of Sale" and to the summary document on the Right of Withdrawal and therefore, all the information already contained in the summary of the commercial and contractual conditions viewed and accepted before proceeding with the purchase.
3. Guarantees and indication of product prices
3.1
On tramatelier.com, only products bearing the TRAME brand and produced directly by the Seller are offered for sale.
3.2
The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market.
3.3
The essential characteristics of the products are presented on trameatelier.com within each product sheet. The contents may be periodically updated, however, the product actually delivered may present slight and non-substantial differences compared to what is published in the images/descriptions within trameatelier.com. Such differences, where present, fall within the manufacturer's right to make improvements to its products, without reducing their commercial value. The images and colors of the products offered for sale on trameatelier.com may however not correspond to the real ones due to the Internet browser and monitor used.
3.4
Product prices may be subject to change. Make sure you know the final sale price before submitting the relevant order form.
If during the product selection procedure you should find that the price of one or more of the products you intend to select for subsequent purchase is clearly lower than the price normally applied, net of any discounts and/or promotions in force at that time, due to a technical problem that occurred on the website, you are requested not to complete your purchase order. In any case, in the event that the purchase order is completed despite a recognizable error in the indication - by the Seller - of the price of a product or in the calculation of the amount requested for payment, the Seller will cancel the order, sending you a communication to this effect via email, to the email address you indicated when transmitting the order and will refund the price paid in relation to the cancelled order, including shipping costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same means of payment you used for the initial transaction.
3.5
Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.
3.6
All product prices on the site do not include Duties, Customs Costs and Import Taxes from Italy. These costs are the responsibility of the buyer who can pay them to the courier upon delivery of the package or previously when notified by the courier of the amounts to be paid. Since it is not possible to predict an estimate of these costs, we recommend that the buyer contact the Customs Agency of their country to have an estimate.
3.7
All products sold by the Seller are covered by the legal guarantee of twenty-four (24) months for lack of conformity, in accordance with the applicable law. The lack of conformity can be communicated to the Seller by contacting Customer Service. In the event of a lack of conformity, you have the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or are excessively onerous, you will be entitled to a reduction in the price paid or to the termination of the sales contract, pursuant to art. 135 bis of the Consumer Code.
3.8
Unless otherwise provided in these “General Conditions of Sale”, the Seller’s liability for products purchased on the website will be limited exclusively to the purchase price of the product in question. Without prejudice to the provisions of the applicable legislation and provided in these “General Conditions of Sale”, the Seller assumes no liability for indirect damages, such as:
1) loss of profit;
2) loss of business, loss of profits or loss of contracts;
3) loss of expected savings;
4)data loss.
Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, the Seller does not guarantee the accuracy and security of the information transmitted or obtained through this website, unless expressly stated otherwise. These provisions do not limit in any way the rights recognized to consumers by current legislation.
4. Payments
4.1
To pay the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order form. In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument chosen by you.
4.2
In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to the platforms that provide the related remote electronic payment services, without third parties being able to access them in any way. Furthermore, such information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of fraud on trameatelier.com. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to the payment method used at the time of shipment of the purchased products.

Please pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these “General Conditions of Sale” and, therefore, are considered to be fully known and accepted by you at the time of transmission of the order form.

8. Refund times and methods
8.1
Whatever the payment method used by you, the refund, whether full or partial, is activated by the Seller, as quickly as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, after verifying the correct execution of your right of withdrawal and checking the returned products.
8.2
The Seller will refund using the same means of payment you used to purchase the returned products, unless you have expressly agreed with the Seller to use a different means of payment and provided that you do not incur any additional costs as a consequence of the refund. If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be made by the Seller, in any case, to the person who made the payment.

10.1
The “General Conditions of Sale” are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005, on the Consumer Code in Chapter I “Consumer Rights in Contracts”, with specific reference to the legislation on distance contracts and by Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.
10.2
In the event of disputes between the Seller and each end user, arising from the "General Conditions of Sale", we inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr .
11. Modification and update
The “General Conditions of Sale” are modified from time to time also in consideration of any regulatory changes. The new “General Conditions of Sale” will be effective from the date of publication on trameatelier.com.
