Paola Palopoli-Ditta Individuale, as Data Controller (hereinafter, “TRAME” or “Controller”) pursuant to Regulation (EU) 2016/679 (hereinafter “GDPR”) and Legislative Decree no. 196/2003 (“Privacy Code”) – undertakes to protect the confidentiality of the personal data of users of its website. This “Privacy Policy” is intended to inform, pursuant to articles 13 and 14 of the GDPR, those who interact with the website www.trameatelier.com (hereinafter “Site”), both through simple consultation and through the use of specific services made available through the Site, regarding the methods with which personal data will be processed during use of the same. This information is not intended to be provided for other websites that may be consulted via links contained in this Site.

The processing of personal data will be based on the principles of correctness, lawfulness, transparency, limitation of purposes and storage, minimization and accuracy, integrity and confidentiality, as well as the principle of accountability pursuant to art. 5 of the GDPR.

“Processing of personal data” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

 

1. DATA CONTROLLER AND DATA PROTECTION OFFICER

2. PERSONAL DATA SUBJECT TO PROCESSING

The personal data processed may consist of an identifier such as a name, an identification number, location data, an online identifier or one or more characteristic elements of the physical, physiological, psychological, economic, cultural or social identity suitable for making the interested party identified or identifiable, depending on the type of services requested (hereinafter only "personal data").

The personal data processed through the Site are the following:

a. Browsing data

The computer systems and software procedures used to operate the Site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of computers used by users who connect to the Site, URI (Uniform Resource Identifier) ​​addresses of requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user's computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the Site to check its correct functioning, to identify anomalies and/or abuses; the data is deleted after processing, unless it is necessary to identify those responsible in the event of hypothetical computer crimes against the Site or third parties.

b. Data voluntarily provided by the user

Except for reference to specific information that may be available in the various sections of the Site, this "Privacy Policy" is also intended to be provided for the processing of data voluntarily entered in the various forms contained within the Site, such as, for example, the information request form in the Contacts section , for sending requests for support to the "Customer Service", in which you are asked to enter your personal data (name and surname), contact details (email address and telephone number), the order number as well as to select and formulate a specific request, which may possibly contain further  personal data; with reference to such types of data, we invite you to share within the aforementioned form only the personal data strictly necessary for the purposes of managing the request, thus excluding information that is not pertinent and/or that may fall within the category of special categories of personal data pursuant to art. 9 of the GDPR ([…] personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data intended to uniquely identify a natural person, data relating to health or sexual life or sexual orientation of the person). In the event of the transmission of personal data, including documents and/or images, that is not pertinent or strictly necessary for managing the request, the Data Controller will refrain from processing such data and will proceed to their immediate cancellation.

c. Data processed in relation to the services provided online

Except where reference is made to specific information that may be available in the various sections of the Site, this “Privacy Policy” is also intended to apply to the processing of data voluntarily provided for the purposes of performing the services provided online, with particular reference to the following services:

- service for creating a personal account and accessing the personal area of ​​the Site, within which personal data (in particular name, surname, date of birth), contact data (email address and telephone number) and, if provided, information relating to your preferences on the Site will be processed. As part of the registration process and access to the personal area, personal data are provided directly or transmitted to the Data Controller by third parties, as independent data controllers. Within the personal area, the Data Controller will process, in addition to the data above, additional personal data, such as, for example, the shipping addresses indicated for purchases, information relating to the history of purchases made, information relating to the chosen payment methods;

- conclusion and execution of purchase contracts (including the sending of service communications such as, for example, the email confirming the purchase, shipping updates, updates on the availability of the products at the collection point, management of the product warranty as well as the related accounting, payment processing, administrative and after-sales assistance services activities), both as a registered user and as a guest user, within which personal data, contact details, details relating to the products purchased, shipping addresses of the products purchased, billing data and any other information relating to the purchase experience will be processed, including information relating to payment methods, including the data of the credit/debit card used for payment and information relating to the transaction carried out using the payment method selected from those available from time to time. In this regard, we inform you, pursuant to art. 14 of the GDPR that, following the choice to use one of the aforementioned payment methods, the banking institution, Paypal, Apple and/or Google, as independent data controllers, will communicate to TRAME only the information relating to the circumstance of the payment having been made.

- order status verification service, which will process the order number and the email address associated with the order;

- return service, within which personal data, contact details, the address for any collection of returned products, the order number and information relating to the purchase and the products being returned will be processed, as well as any information relating to the purchase and return experience; the return service also includes the sending, by TRAME, of service communications such as, in particular, the confirmation email regarding receipt of the withdrawal request, the return acceptance email, or, if a decrease in the value of the returned products is found, the communication regarding the amount deducted as a reduction in the refund;

- Book an appointment function , within which you will be asked to enter personal information, in particular personal and contact details, as well as possibly formulate a message for the staff which may possibly contain further personal data, in order to arrange appointments in our boutiques;

- “Wishlist” service, through which you can add items to your wish list in your personal area;

- “Click & reserve” service, for the online reservation of products with collection at the boutique, in which personal data, contact details and information relating to the reserved products will be processed; the service in question also includes the sending, by TRAME, of an email communication aimed at updating the availability of the products at the boutique.

With respect to shipping addresses, the data controller for geographic location data and other information processed is Google ( Google Privacy Policy ).

In general, furthermore, the Data Controller will process any other information relating to the purchase, such as the type of product purchased, the date of purchase, the amount spent, the information relating to the products inserted in the “virtual cart” of the Site which may be processed, subject to consent, for sending the reminder email of the products inserted in the cart and for which the “checkout” process has not been completed (so-called “abandoned cart email”), as well as, in general, the purchasing choices, the preferences for the purposes indicated below; the Data Controller will also process the information deriving from the choices of customization of the contents of the newsletter.

 

d. Third party data voluntarily provided by the user 

When using the services of the Site, the personal data of third parties communicated to TRAME may be processed (for example, in the case of data provided in the contact form; in the personalized message possibly included in the greeting card in the event of selecting the "gift" option during the purchase phase; etc.). With respect to these hypotheses, the buyer acts as an independent data controller, assuming all legal obligations and responsibilities. In this sense, the buyer grants the broadest indemnity on this point with respect to any dispute, claim, request for compensation for damage from processing, etc. that may be received by the Data Controller from third parties, whose personal data have been processed through his/her use of the services of the Site in violation of the applicable rules on the protection of personal data. In any case, if the buyer provides or otherwise processes personal data of third parties in the use of the Site, he guarantees from now - assuming all related liability - that this particular hypothesis of processing is based, where necessary, on the prior acquisition - by the buyer - of the third party's consent to the processing of information concerning him.

e. Data processed for sending products/gifts to subjects other than the user of the Site 

This information is also provided pursuant to and for the purposes of art. 14 of the GDPR to those who receive products/gifts purchased through the Site and whose personal data are provided to the Data Controller by the user of the Site at the time of purchase of goods in their favor, to ensure that the Data Controller can fulfill its contractual obligations, including the shipment of the products/gifts.

The personal data processed are in particular personal data (name, surname) and contact data (e.g. telephone number, shipping address).

f. Cookies and other tracking technologies

3. PURPOSE, LEGAL BASIS OF THE PROCESSING AND NATURE OF THE PROVISION

Personal data will be processed, with consent where necessary, for the following purposes:

a) allow navigation of the Site, registration in the private area and the provision of all the services made available therein by the Data Controller (such as, by way of example and not limited to, the online sales service, product returns, the “Wishlist” service, “Click&reserve”, the “Book an appointment” function, checking the status of orders, as well as contractual and administrative-accounting relations and after-sales services, etc.), including the management of the security of the Site.

b) respond to specific requests addressed to the Data Controller, also in relation to post-sales, including requests for customer assistance and information forwarded by filling in the relevant contact forms on the Site;

c) subscription to the newsletter, to receive commercial, promotional and direct marketing communications and information on TRAME services, products and offers via email;

d) sending communications and information of a commercial, promotional and direct marketing nature, including newsletters, market research, invitations to events, through automated contact systems (such as email, instant messaging systems, TRAME social media channels) and non-automated contact systems (such as paper mail and telephone with operator); it is specified that the Data Controller collects a single consent for the marketing purposes described here, pursuant to the General Provision of the Guarantor for the Protection of Personal Data "Guidelines on promotional activities and the fight against spam" of 4 July 2013; if, in any case, you wish to oppose the processing of data for marketing purposes carried out with some or all of the contact means indicated above, you may do so at any time by contacting the Data Controller at the contact details indicated in paragraph 1 of this information, without prejudice to the lawfulness of the processing carried out before the opposition;

e) data analysis for profiling purposes by TRAME, including profiling relating to the sending of offers, discounts and any other benefits and promotional initiatives modelled on interests and purchasing behaviour and propensities (e.g. purchasing volumes, consumption habits and choices), including data collected online via tracers (e.g. cookies, pixels, tags, etc.) on the TRAME website or on third-party sites, to personalise commercial and promotional communications based on the profile, interests and purchasing propensities;

f) direct sending by email and/or post of advertising material and commercial communications in relation to products or services similar to those already purchased, pursuant to art. 130, paragraph 4 of the Privacy Code as well as the Provision of the Authority for the Protection of Personal Data of 19 June 2008, unless you expressly refuse to receive such communications, which you may express during registration on the Site or on subsequent occasions;

g) fulfill any obligations established by applicable laws, regulations or community legislation, or satisfy requests from the authorities;

h) satisfy any defense needs both in the pre-trial and judicial phases;

The legal basis for the processing of personal data for the purposes referred to in letters a) and b) is to be found in art. 6, par. 1, letter b) of the GDPR ([…] processing is necessary for the performance of a contract to which the data subject is party or for the implementation of pre-contractual measures adopted at the request of the same), as the processing is necessary for the provision of the services requested by the data subject. The provision of personal data for the aforementioned purposes is optional, however, failure to provide such data may make it impossible to activate and provide the requested services.

The processing carried out for the purposes referred to in letters c), d) and e) are based on the consent expressed pursuant to art. 6, par. 1, letter a) of the GDPR ([…] the interested party has expressed consent to the processing of his or her personal data for one or more specific purposes) and art. 22, par. 2, letter c) of the GDPR.

Please note that, with reference to the sending of emails relating to the abandoned cart, this processing may be carried out by the Data Controller only in the presence of the consents previously granted by you for the purpose of receiving commercial and promotional communications via email as per letters c) or d) above and for the profiling purpose as per letter e) above.

Consent may be revoked at any time without prejudice to the lawfulness of the processing carried out prior to the revocation in accordance with the provisions of art. 7 of the GDPR.

The provision of personal data for these purposes is therefore entirely optional and does not affect the use of the services. Should you wish to object to the processing of your data for marketing and/or profiling purposes, you may do so at any time by contacting the Data Controller and/or the DPO at the contact details indicated in paragraph 1 of this “Privacy Policy”.

With reference to the purpose referred to in letter f), it is specified that if the Data Controller uses, for the direct sale of its own products or services, the electronic or paper coordinates provided by the interested party in the context of the sale of a product or service, it may, pursuant to art. 130, paragraph 4 of the Privacy Code, not request the interested party's consent, provided that the products or services are similar to those being sold and the interested party, adequately informed, does not refuse such use, initially or on the occasion of subsequent communications.

The purpose referred to in letter g) represents a legitimate processing of personal data pursuant to art. 6, par. 1, letter c) of the GDPR ([…] the processing is necessary to fulfill a legal obligation to which the data controller is subject). Once the personal data has been provided, in fact, the processing is indeed necessary to fulfill legal obligations to which the Data Controller is subject.

The processing referred to in letter h) is carried out in order to pursue the legitimate interest of the Data Controller pursuant to art. 6, par. 1, letter f) and 9, par. 2, letter f) of the GDPR, as once the personal data have been provided, the related processing may become necessary to ascertain, exercise or defend a right in court or whenever the judicial authorities exercise their functions.

 

4. RECIPIENTS OF PERSONAL DATA

Personal data may be shared, for the purposes set out in paragraph 3 of this Privacy Policy, with:

1. persons authorised by the Data Controller to process personal data pursuant to articles 29 of the GDPR and 2-quaterdecies of the Privacy Code (e.g. personnel in charge of sales, administration and accounting, after-sales assistance, CRM, information systems management, etc.);

2. third parties who, in providing services (for example: technological services, accounting, administrative, legal, tax and financial assistance and consultancy services, hosting providers, suppliers of technical maintenance services, suppliers of marketing and communication services, transport services, etc.), typically act as data controllers pursuant to art. 28 of the GDPR. The Data Controller maintains an updated list of data controllers and guarantees that the interested party can view it at the above-mentioned office as well as by sending a written request to the Data Controller at the contact details indicated in paragraph 1 of this “Privacy Policy”;

3. subjects, bodies or authorities to whom it is mandatory to communicate personal data by virtue of provisions of law or orders of the authorities;

 

These subjects are, hereinafter, collectively defined as “Recipients” .

 

5. TRANSFER OF PERSONAL DATA OUTSIDE THE EU

The personal data provided through the Site will be processed and stored in the information systems of the Data Controller located within the European Economic Area and also outside the European Economic Area. In the latter case, the transfer will take place in compliance with the conditions indicated in articles 44 et seq. of the GDPR, such as the adoption of Standard Clauses approved by the European Commission, the selection of subjects adhering to international programs for the free circulation of data or operating in countries considered safe by the European Commission, in compliance with the recommendations 01/2020 adopted on 10 November 2020 by the European Data Protection Board. It is possible to request further information, upon request, regarding the data transfers carried out and the guarantees adopted for this purpose, from the Data Controller and/or the DPO at the contacts indicated in paragraph 1 of this information.

 

6. STORAGE OF PERSONAL DATA

Personal data will be collected and stored in accordance with the principles of minimization and limitation of storage pursuant to art. 5.1.c) and e) of the GDPR, ensuring security measures to prevent data loss, illicit or incorrect use and unauthorized access.

The personal data processed for the purposes referred to in letters a) and b) of paragraph 3 of this Privacy Policy” will be retained for the time strictly necessary to achieve those same purposes, i.e. for the time necessary to execute the contract, to provide legal or conventional guarantees, in accordance with the retention times required by law.

For direct marketing purposes referred to in letters c) and d) of paragraph 3 of this information notice, personal contact data will be processed until opposition or withdrawal of consent. It should also be noted that personal data processed for profiling purposes referred to in letter e) of paragraph 3 of this information notice and personal data relating to the profile processed for the purpose of sending personalized commercial and promotional communications will be retained for such purposes for a period of time not exceeding seven years from their collection and/or registration, after which TRAME has decided to proceed with the automatic deletion of personal data, or their transformation into anonymous form in a permanent and non-reversible manner, unless previously revoked or opposed to the processing.

In general, the Owner reserves the right to retain the data for the time necessary to fulfill any regulatory obligation to which it is subject or to satisfy any defensive needs. Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access.

Further information regarding the data retention period and the criteria used to determine this period may be requested by sending a written request to the Data Controller and/or the DPO at the addresses indicated in paragraph 1 of this information notice.

 

7. ANY AUTOMATED DECISION-MAKING PROCESSES

TRAME does not use automated decision-making processes without consent, including profiling as per Article 22, paragraphs 1 and 4 of the GDPR. If you consent to profiling, the data provided may be used to analyze or predict your tastes and preferences, in order to personalize the content of marketing communications and offers of personalized products and services. In particular, the analysis may concern the number, type, value and regularity of purchases of products made over a seven-year period. Following this analysis, which may also be carried out in an automated form, you may be classified into one or more groups with different characteristics and receive communications that TRAME deems personalized to certain tastes and preferences. For example, if only certain types of products for a certain value are purchased within a period of 7 years, it is possible that you may receive marketing communications in the future with reference to similar products in a similar price range. On the contrary, you may receive fewer communications and promotions relating to other types of products if you have never purchased them in the reference period, as the system assumes that it is not a product of interest. On this data processing, before starting it, TRAME has conducted a specific data protection impact assessment to ensure that profiling is carried out neutrally, accurately, efficiently and without harmful consequences for the data subject. As required by art. 22, paragraph 3, of the GDPR, the Data Controller implements all the most appropriate measures to protect rights and freedoms even in the case of profiling, in addition to any further legitimate right as better explained in the following paragraph 8 of this "Privacy Policy".

 

8. RIGHTS OF INTERESTED PARTIES

As an interested party, you may assert your rights and/or request information on the processing of your data by contacting the Data Controller at the contact details indicated in paragraph 1 of this “Privacy Policy”, preferably by inserting the wording “Request to exercise privacy rights” in the subject of the communication.

 

In particular, you may exercise the following rights at any time:

  • right to revoke any consent given (art. 7 of the GDPR) – you have the right to revoke any consent given at any time, without prejudice to the lawfulness of the processing carried out prior to the revocation;
  • right of access (art. 15 of the GDPR) – you have the right to obtain confirmation as to whether or not personal data concerning you are being processed, as well as the right to receive any information relating to such processing;
  • right of rectification (art. 16 of the GDPR) – you have the right to obtain the rectification of your personal data, if they are incomplete or inaccurate; please note that, with respect to personal data collected through audio and video recording systems, the right of rectification cannot be exercised in practice, given the intrinsic nature of the data collected, which relate to an objective and specific fact;
  • right to erasure (art. 17 of the GDPR) – in certain circumstances, you have the right to obtain the erasure of personal data held in our archives;
  • right to restriction of processing (art. 18 of the GDPR) – when certain conditions apply, you have the right to obtain restriction of the processing of your personal data;
  • right to portability (art. 20 of the GDPR) – you have the right to obtain the transfer of personal data to a different data controller as well as the right to obtain the data relating to you in a structured, commonly used and machine-readable format;
  • right to object (art. 21 of the GDPR) – you have the right to make a request to object to the processing of your personal data, in which you must provide evidence of the reasons justifying the objection; the Data Controller reserves the right to evaluate this request, which may not be accepted if there are compelling legitimate reasons to proceed with the processing that prevail over your interests, rights and freedoms. You also have the right to object at any time and without any justification to the sending of commercial, promotional and direct marketing communications, including newsletters, market research, invitations to events, through automated and non-automated contact systems, including profiling to the extent that it is connected to such direct marketing. With regard to this type of communications, the possibility of exercising this right remains intact, even in part, i.e. by objecting, for example, only to the sending of promotional communications carried out through automated tools. We also inform you that you have the right to object at any time and without any justification to profiling;
  • right to lodge a complaint with the Supervisory Authority (art. 77 of the GDPR) - in the manner indicated in the following paragraph, in the event that you believe that your processing violates the legislation on the protection of personal data, you can lodge a complaint with the Supervisory Authority of the Member State in which you habitually reside, work or the place where the alleged violation occurred;
  • right to bring an action before the appropriate courts (Article 79 of the GDPR).
